ITA appeal back to Local Debt Commission

FRANKFORT - Franklin Circuit Court Judge Roger Crittenden granted a motion to send an appeal of a $25 million bond issue for the Kentucky Trimodal Transpark back to the state's Local Debt Commission this morning.

The appeal, filed by transpark opponent Joey Roberts, questioned the commission's ruling, made in September, that upheld the decision of a state local debt officer to allow the bond issue by Warren County Fiscal Court.

Robert's attorney, Tom FitzGerald of the Kentucky Resources Council, then appealed the decision to circuit court, charging in part that the county debt commission acted improperly by failing to consider FitzGerald's exceptions to the decision of J. Patrick Abell, the hearing officer who heard the appeal case.

Both sides were agreeable to the remand since it will allow any possible errors to be ironed out before the court rules on the merits of the case, InteModal Transportation Authority President Dan Cherry said.

The Local Debt Commission probably will meet in January to reconsider the case and issue a new opinion, Cherry said.
